Legal Counsel for Long-Term Care
WA Office of Civil Legal Aid (OCLA)
Provides legal assistance to Medicaid-eligible adults living in residential long-term care settings (Adult Family Homes, Assisted Living Facilities, Enhanced Services Facilities) when they face discharge, transfer, or have been removed without proper notice. Helps residents understand their rights, access timely legal assistance, and avoid unsafe or unlawful removals. Services range from full legal representation in administrative appeals, negotiations, and court proceedings to one-time advice and self-advocacy resources.
Who qualifies
Residents currently living in (or removed within the past 60 days from) an AFH, ALF, or ESF in Washington State who are Apple Health (Medicaid)-eligible and who have received a discharge/transfer notice or were removed without proper notice.
What it covers
Full legal representation, advice & technical assistance on rights and process, self-advocacy resources, interpreter services, reasonable accommodations.
Cost
Free for those who meet eligibility (Medicaid status + qualifying facility/discharge situation). State-funded through OCLA, delivered by contracted legal service providers.
